1. Any variation to the conditions outlined below are inapplicable unless accepted in writing by Charles Birch Limited.
General Liability
2. You must be 16 years or older to register for the service. By submitting an order you confirm to us that you are at least 16 years of age.
3. We shall not be liable to you for any loss or damage unless such loss or damage arises as a direct result of our negligence, recklessness or wilful misconduct, or fraud or misrepresentation on our part.
4. No claim by you against us shall be valid unless you have notified us of the details of the claim within one year of it arising.
Placing an order
5. All prices in our literature were correct at the time of going to press. However, the seller reserves the right to alter prices and discontinue products without prior notice. All prices shown are quoted in UK pounds Sterling and include VAT where applicable, orders shipped to countries outside the EU may be subject to additional Sales Taxes and Import Duties.
6. All descriptions in our literature and website are approximate and are not subject to a guarantee of accuracy.
7. No condition is made, or any warranty given as to the performance or life and wear of goods supplied.
8. Nothing on our website is intended or shall be interpreted to mean that we are making a legal offer to you to provide the goods; we are inviting you to make a legal offer to us to purchase the goods. It is entirely at our discretion to accept or reject the offer of purchase.
9. The agreement is concluded only when we have accepted your order by sending you a confirmation form.
10. Payment can be made using any of the methods listed on this website and will be debited when we have accepted your offer to purchase.
11. Our acceptance of your offer to purchase goods is subject to their availability. Our acknowledgement of order acceptance via web or email is not a guarantee of delivery. We will inform you if we are unable to deliver the goods.
Delivery and Returns
12. Any date for delivery named by the seller is subject to alteration at the seller’s discretion and the seller shall not be liable for any such delay.
13. All deliveries are subject to stock availability and authorisation of your payment.
14. Goods represented by the buyer to be defective shall not form the subject of any claim for any loss, damage or expense incurred by the buyer, but such goods - if returned to the seller and accepted by him as defective – will (at the request of the buyer) be replaced as originally ordered (if practical).
15. No claim for damage in transit, shortage of delivery or loss of goods will be entertained unless, in the case of damage in transit or shortage of delivery, the buyer gives notice to the seller within seven days of the date of the invoice for goods.
